About Kelly

Kelly is a Partner and is the head of our Estate Planning and Tax team.

Kelly leads the Estate Planning and Tax team at Steele Raymond and is dual qualified as a solicitor and Chartered Tax Advisor (CTA).  Kelly holds an advanced diploma in international taxation – with a specialism in UK/US tax. She has over 15 years’ experience in tax planning for high net worth individuals, including succession planning for business owners, international estate planning and dealing with international capacity issues. She also acts as an expert witness on tax issues.

Recently elected as worldwide chair of STEP – the Society of Trust and Estate Practitioners (an organisation which is the quality mark of excellence for private client advisors), Kelly regularly provides commentary and responses to government consultations on legislative changes and presents at international debates and conferences around the world.

Kelly also brings to the firm her specialist Court of Protection experience, as one of only 68 solicitors nationwide elected to the Office of the Public Guardian’s national panel of professional deputies, which she sat on for 8 years.

Kelly was the sole legal professional on the Money and Pension Service’s Later Life steering committee, which was involved in shaping the future of later life planning in the UK.

  • Planning

    Kelly acted for a widow whose spouse had died leaving a simple will, she was able to advise of a deed of variation creating various trusts for tax saving and asset protection ensuing that the residence nil rate band could be fully utilised. All joint properties benefited from a discount for IHT purposes and with some lifetime planning with the widow was able to reduce the potential IHT exposure on second death significantly as well as protecting the assets for future generations.

  • Executor of Cross Jurisdiction Will

    Kelly acted as an administrator in a disputed estate, where the deceased had not sought appropriate advice during his lifetime. The estate included assets in various jurisdictions and a partial intestacy. Incorrect CGT returns had been made to HMRC which needed to be rectified. There were disputes as to the ownership of assets and the validity of trust documents. There were also disputes over various lifetime gifts and whether they were loans or gifts.

  • International Tax Planning

    Kelly acted for a UK domiciled non resident who was due to repatriate back to the UK. She provided advice as to the statutory residence test and split year treatment and was able to advise on a solution to avoid a large income tax bill in the intended year of arrival.

  • Court of Protection

    Kelly was one of the Deputies and applicants in the reported case ACC & Other which clarified the position as to when a deputy can instruct their own firm for legal advice.

    During her time as a deputy Kelly developed a specialism for dealing with financial abuse cases, and as such was given some of the most challenging cases on the circuit.

  • Unwinding Missold Trusts

    Kelly has spent a significant amount of time in practice, acting for those who have been missold trusts – perhaps in an attempt to avoid care fees or other liabilities. Often the tax consequences are not fully explained and it is necessary to take action to make these trusts fully compliant, rectify any historical tax issues and look at unwinding the original structures.

  • Remittance Basis Planning & Mixed Funds

    Kelly acted for a non domiciled individual currently resident in the UK and claiming the remittance basis of taxation and overseas workday relief. Unfortunately the individual had not been provided with appropriate pre-arrival planning advice and had not structured his affairs accordingly. Kelly provided advice as to the mixed fund remittances and the amount he could bring into the country without further tax charge. Kelly spent time unwinding some of the previous actions and gave advice regarding the restructuring of accounts such that the issue could not arise again.
